MEETING MINUTES | APRIL 22nd, 2010   

Meeting holds on April, 22nd 2010, by the Insolvency Commission of the Union Internationale des Avocats (from now on UIA), in New York, in the Grand Hyatt Hotel, which is located in 109 East 42nd, at 10 am,

Although his attendance was previously announced, D. Rubén Acosta (Mexico) finally he didn’t attend it.

DEVELOPMENT:  

D. José Pajares Echeverría takes on the meeting President Position and D. Ángel Mª Ballesteros Barros the Secretary Position. The development of the content for the agenda suggested is carried out. 

1º.- Reading and approbation of the last meeting minutes 

Those presents approve the minutes for the meeting held in Seville, on October 30, 2009.   

2º.- Activities for the Commission  

The President informs about the activities for the Commission which are mentioned in detail in the last newsletter. For this reason he refers to this newsletter, expanding the question made and highlighting the more important questions for the future of the 

Commission and particularly the following ones:  

A) During the UIA Annual Congress hold in Seville between October 27-31, 2009, our Commission developed its lecture “Business Law: worldwide business and world financial crisis” having a great success in the participation.  

B) It is informed by the President that two members of this Commission on behalf of the UIA will attended the 36-37 sessions of the Working Group V (Insolvency Regime) for United Nations Commission for International Commercial Law (UNCITRAL). These sessions were hold in New York in May, 18-22, 2009 and in Vienne, November, 9-13, 2009. In this moment they are attending the 38 Session in April, 19-23, 2010 in New York.  

3º. - Renewal Vice President’s office 

As any decision has been taken in the last meeting hold in Seville, and as it’s clear that the position designed in the Commission must be participant and participative in the development, the appointment for a new Vice President would be suggested in 

the next meeting. This decision will be taken between the members who really fulfil the conditions, especially when he is going to be a replacement for the President, so it might deal with all the questions in the Commission. For this reason he can’t be someone who doesn’t take active part in the Commission  

4º.- Jointly seminar with Family Law Commission 

The task before the Family Law Commission in order to celebrate in 2011 a jointly seminar in the UIA are informed. The date and the place are not definitely decided, and the participation for the major number of members of the Commission is requested.   

5º.- UNCITRAL: 38 session in New York 

It is informed by the President that two members of this Commission are going to take part in behalf of the UIA in the 38 Session for Working Group V (Insolvency regimen) in the United Nations Commission for International Commercial Law (UNCITRAL). This Session is being celebrated in New York between April, 19 and 23, 2010. Those who are taking part are defending behalf UIA a proposal for future 

working of the Group V of UNCITRAL.  

The commission approves and celebrates this participation. Its members request the UIA his appreciation and that guaranteeing the continuity of this task is necessary. In fact it is decided that they will contribute with the amount that could be necessary.  

It is informed the participation in the 39 working session which will be celebrated in Vienne between November 1-.5, 2010.  

6º.- Istanbul Congress 

The working session of the Commission will be held during the annual Congress in Istanbul, specifically in November 2nd, from 2.30 to 5.00 p.m. 

7º.- Any other Business  

It is set the date for the next meeting of the Insolvency Commission during the annual congress in Istanbul. Specifically it is set next November 2nd, after the working session which will be held from 2.30 to 5.00 p.m. 

Without having no more question to analyze, the meeting is adjourned at 12 am.
